Federal regulations require small municipal separate storm sewer system (MS4) operators to develop and carry out a written stormwater management plan that documents how the MS4 operator intends to implement six minimum control measures:

  • Public Education and Outreach on Stormwater Impacts
  • Public Involvement/Participation
  • Illicit Discharge Detection and Elimination
  • Construction Site Stormwater Runoff Control
  • Post-Construction Stormwater Management in New Development and Redevelopment
  • Pollution Prevention/Good Housekeeping for Municipal Operations

As published in 1999, the federal regulations provide MS4 operators a great deal of flexibility in implementing the minimum control measures in a manner most appropriate for their individual circumstances. With each successive permit renewal, the flexibility in minimum control measure implementation has eroded. Recommendations and guidance governing implementation of minimum control measures have been replaced with enforceable regulatory conditions.
